Legal

In some cases even the most diligent collection agency efforts cannot produce satisfactory results, and it may be in the client's best interests to institute or take part in legal proceedings to collect the amounts due. Providers frequently encounter individual debtors or other responsible parties who without justification refuse to pay for the services provided. MAS will conduct the necessary investigations and evaluations to determine whether the responsible party possesses the financial wherewithal to satisfy the debt. In this case, and in certain other situations, hiring an attorney may be the provider's best course of action.

The most frequently encountered situations that may warrant attorney involvement are:

  • provider lien claims against personal injury funds
  • probate claims
  • bankruptcy creditor claims
  • unjustified refusal to pay

Medical Accounts Systems is uniquely equipped to counsel its clients on the costs and benefits associated with initiating or participating in litigation on a particular claim or class of claims. Medical Accounts Systems' principals are active members of the Florida Bar and practicing attorneys at Jorge M. Abril, P.A., a law firm practicing mainly in commercial, consumer, and medical debt collection. In fact, a number of Medical Accounts Systems' clients have chosen to engage Jorge M. Abril, P.A. to file suit on their claims after collection efforts at the agency level have proven fruitless, and some clients have even chosen to enter into a three way relationship from the outset.

The decision to hire an attorney or to initiate a lawsuit on a particular claim is an important decision that rests solely within the hands of the client. Your fee arrangement with Medical Accounts Systems will not be affected by your decision to hire an attorney or the fees the attorney charges you. Medical Accounts Systems does not engage in the practice of law and is not licensed to do so, and legal representation is not contemplated by your agreement with Medical Accounts Systems.
